North Phoenix Living Trust FAQs

Have another Living Trust or Estate Planning question? Contact the Sise Law Firm to speak with a North Phoenix estate planning attorney.

Yes, in many cases a North Phoenix homeowner can transfer a mortgaged home into a revocable living trust. Having a mortgage does not automatically prevent the home from being placed in a trust. The deed, trust, mortgage, and insurance should be reviewed so the transfer is handled properly.

Paying off your home does not determine whether it will avoid probate. How the property is titled and what estate planning arrangements you have in place are what matter. A properly created and funded living trust can provide a plan for transferring your North Phoenix home and other assets after death.

Generally, yes. With a revocable living trust, you typically retain control of the property while you are alive and can sell the home. The trust does not mean your house is permanently locked away. The sale should be handled consistently with the property's title and the terms of your trust .

Creating a living trust alone does not automatically place your home into the trust. If your Arizona home remains outside the trust, the trust may not control what happens to that property after your death. Properly funding the trust, including transferring appropriate real estate, is an important part of completing an estate plan.

A rental property can often be included in a living trust, but additional issues may need to be considered, including how the property is titled, insurance, financing, and whether an LLC or another ownership structure is involved. A living trust can address estate planning, but it does not by itself provide liability protection for operating a rental property.

It depends on the couple's property, family situation, and estate planning goals. Some Arizona married couples use a joint living trust, while separate trusts may make sense in other situations, including certain blended-family or separate-property circumstances. The estate plan should be designed around the couple rather than using the same trust structure for every family.
